IT НОВОСТИ: Biden DOJ argues it should substitute for Trump as defendant in lawsuit 2021

The Justice Department argued in a brief filed Monday that it should be permitted to substitute itself for former President Donald Trump as defendant in a defamation lawsuit brought by a longtime magazine columnist, E. Jean Carroll, who accused him of rape, continuing the argument it had initiated under the previous administration even as the White House has changed hands.
«Then-President Trump’s response to Ms. Carroll’s serious allegations of sexual assault included statements that questioned her credibility in terms that were crude and disrespectful,» Justice Department lawyers wrote in a brief to the 2nd US Circuit Court of Appeals. «But this case does not concern whether Mr. Trump’s response was appropriate. Nor does it turn on the truthfulness of Ms. Carroll’s allegations.»
Rather, the lawyers wrote, because they believe Trump was an employee of the government and that he acted «within the scope of employment,» the department, rather than Trump personally, should serve as defendant in the case.
In submitting the brief Monday, the department continued the argument it has been making for months: that a president’s comments are an official function of his job, even if they pertain to a personal matter. Since it first took that position, however, Trump has been replaced by President Joe Biden, and while the brief the department filed included plenty of unkind words regarding the former President’s behavior, it will benefit Trump if it succeeds.
«Speaking to the public and the press on matters of public concern is undoubtedly part of an elected official’s job,» they wrote. «Courts have thus consistently and repeatedly held that allegedly defamatory statements made in that context are within the scope of elected officials’ employment — including when the statements were prompted by press inquiries about the official’s private life.»
The White House said it hadn’t been consulted by the Justice Department before the brief was filed.

  20. the Problem is Garland. I think Biden blew it nominating/appointing Garland as AG/DOJ. Garland seems more of an appeaser and a Republican than a AG prosecutor. Biden needs to ask him to step down and appoint an aggressive smart prosecutor for that post (someone like Glen Kirschner?). I doubt Garland will pursue any serious charges if any against Sessions, Barr, Giuliani, Meadows, the trump kids, Melanie’s inauguration funds, and especially trump.
    Garland seems more loyal to his political party (GOP) than to our laws and his job.
    He’s already going to use the DOJ to defend trump on his defamation lawsuit, is refusing to open and release Muellers full report nor investigate why Barr was dishonest about what was in it.
    Garland is just another cover up puppet and seems to be worthless on actually pursuing justice and criminal activities by trump and his criminal traitorous syndicate (administration)

Merrick Garland new just like the rest of us knew that Donald Trump did break the law several times but as it stands now Merrick Garland seems to want to put all this behind him and he was asked before he got confirmed would he go all the way to the top if he needed to to make sure the law wasn't being broken and he said yes but I guess there was a loophole in that I reckon what he was saying was you look at Donald Trump's wrongdoing but that doesn't mean that I do anything about it just a couple weeks ago the judge read a report and said that Donald Trump and Bill Barr lied lied and lied again and she was going to make it public unless the justice department appealed it Merrick Garland appealed it as if to say keep it private don't show the public but we've the public were the ones that put him in office so we have a right to see that he was not being truthful as the President of the United States here in the real world you have a right to appeal certain things but the courts don't just leave it at that they let you know if whether or not you won or lost your appeal so will this judge let us know if Merrick Garland in the Justice Department lost his appeal to keep her from making these documents public?

What this justice department has done is correct…..Am not at all a fan of the former guy….But this is not about the person accused or the allegation on that said person……..It is about the DOJ's commitment to impartially apply the laws regardless of partisan politics, and they have taken the first step towards it….
    Yes, i do agree that the law is totally screwed up if it is having to defend a bully and probably a rapist…..and it seriously needs to change….but that needs people using the power of democracy to bring about much needed change to the laws that end up hurting the people it's supposed to defend.
